Six-Figure Judgment Enforced for Creditor

March 26, 2009 - Paul Maloof was recently retained by a large Boston, MA company to handle the domestication and recovery of a judgment of $250,000.00 that was awarded in the U.S. District Court for Massachusetts, Boston Division.

Once the foreign judgment was domesticated in the Courts of Virginia under the U.S. Constitution's Full Faith and Credit Clause, an attorney for the judgment debtor attacked the Massachusetts judgment by asserting it was not a money judgment but merely a declaratory judgment and as such as not recognized by the laws of Virginia.

The issue was joined, a Motion to Quash the Writ of Fi Fa was argued and Paul Maloof successfully argued that the Massachusetts judgment was valid on its face and must be recognized by the Courts of Virginia. Once the judgment debtor's Motion was denied, a payment of the full $250,000.00 plus interest and court costs was paid in the form of a cashier's check to Paul Maloof's client.
